Privacy Policy

Youngbyte (Pty) Ltd respects your privacy. This policy explains what personal information we collect, why we collect it, what we do with it, and what rights you have. It is written to comply with the Protection of Personal Information Act 4 of 2013 (“POPIA”).


1. Who is responsible for your information

Youngbyte (Pty) Ltd (registration number 2012/056995/07) is the responsible party for the personal information described in this policy.

Any privacy question, request, or complaint may be directed to privacy@youngbyte.com and will be dealt with by our Information Officer. Details of our Information Officer are set out in our PAIA Manual, available on request.


2. What we collect

When you contact us through this website Name, email address, telephone number, organisation name (if provided), and the content of your message.

When you become a client Contact details for the people we deal with, billing details, company registration and tax details, and correspondence relating to the engagement.

When you enrol in an Academy programme Name, contact details, identity number where required for certification or accredited programmes, qualifications, assessment results, and attendance or completion records.

When you subscribe to a service Account details, billing information, and usage data relating to the service.

When you visit this website IP address, browser and device type, pages viewed, referring website, and time of visit. This is collected through cookies and server logs. See section 9.

We do not collect or store your card details. Card payments are processed by our payment gateway provider on their own systems.


3. Why we collect it, and our lawful basis

We do not sell your personal information. We do not use it for automated decision-making that has legal consequences for you.


4. Who we share it with

We share personal information only where necessary, and only with:

Service providers who process information on our behalf (operators)

We use third-party providers for the following purposes:

  • Hosting and infrastructure
  • Business email and productivity software
  • Customer relationship management, invoicing, and subscription billing
  • Website security, performance, and spam protection
  • Transactional email delivery
  • Payment processing

Each provider is contractually bound to process personal information only on our instructions and to maintain appropriate security safeguards. You may request details of the providers relevant to a service you use by emailing privacy@youngbyte.com.

Others – Professional advisors such as our accountants and attorneys, where necessary – Certification bodies and accrediting authorities, where you have enrolled in a programme requiring it – Regulators, courts, or law enforcement where we are legally required to disclose


5. Transfers outside South Africa

Some of the providers described above host data outside South Africa, including in the European Union and the United States. Where we transfer personal information across borders, we do so in accordance with section 72 of POPIA — either because the recipient is subject to a law or binding agreement providing protection substantially similar to POPIA, because the transfer is necessary to perform our contract with you, or with your consent.

You may ask us for details of the safeguards applying to any specific transfer.


6. How long we keep it

Information Retention period
Enquiries that do not become engagements 24 months
Client records, contracts, and correspondence 5 years after the engagement ends
Financial and tax records 5 years, as required by the Tax Administration Act 28 of 2011
Academy assessment records and certificates 5 years, or longer where an accrediting body requires it
Website analytics and server logs 12 months

We delete or de-identify personal information once the retention period ends, unless we are required to keep it longer.


7. How we protect it

We apply the security safeguards required by section 19 of POPIA, including:

  • Encrypted connections (HTTPS/TLS) across our website and systems
  • Multi-factor authentication on administrative accounts
  • Role-based access, so staff see only what their work requires
  • Regular software updates and security monitoring
  • Encrypted, regularly tested backups
  • Written agreements with all operators

No system is completely secure. If a security compromise affects your personal information, we will notify you and the Information Regulator as required by section 22 of POPIA.


8. Your rights

Under POPIA you have the right to:

  • Be told what personal information we hold about you
  • Access that information, on request
  • Correct or delete information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, or unlawfully obtained
  • Object to processing based on legitimate interest
  • Withdraw consent at any time, where consent is our basis for processing
  • Opt out of direct marketing at any time
  • Complain to the Information Regulator

To exercise any of these rights, email privacy@youngbyte.com. Requests for access must be made on the prescribed POPIA Form 2. We will respond within 30 days. There is no charge for a request to correct or delete information; a reasonable fee may apply to an access request, and we will tell you the amount before proceeding.

We may need to verify your identity before acting on a request.


9. Cookies

This website uses cookies for:

  • Essential functions — security, session management, and spam prevention. These cannot be disabled.
  • Analytics — understanding how visitors use the site, in aggregate.

You can control cookies through your browser settings. Blocking essential cookies may prevent parts of this website from working.


10. Children

This website is not directed at children, and we do not knowingly collect personal information from anyone under 18 through it.

Where a Youngbyte platform processes information about children — for example a school management system — that processing is carried out on the instruction of the school or institution as responsible party, with consent obtained from a parent or other competent person as required by section 35 of POPIA. Those platforms have their own privacy policies.


11. Direct marketing

We will only send you marketing communications if you have asked to receive them or are an existing client. Every message includes an unsubscribe option, and you may opt out at any time by replying or emailing us. Opting out does not affect service-related communications about work we are doing for you.

If you are unhappy with how we have handled your personal information, please contact us first at privacy@youngbyte.com so that we can try to resolve it. If you are not satisfied with our response, you may complain to:

13. Changes to this policy

We may update this policy. The current version is always published on this website with its effective date. Where a change materially affects how we process your information, we will tell you directly.
